December 12, 2016
The Regular Meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Randy Dodd. In attendance were, Council Jodi Wyborny, Council Tim Dodd, and Council Jessica Prazak, Council Scott Ennis and City Clerk, Tracy Ward. Also in attendance was Laura Dodd, Rick Wyborny, Sharm Ward, Preston and Paige Prazak. Council Mark Brosz arrived late.

Mayor Dodd then asked for a motion to approve the consent agenda. After reviewing the agenda, minutes of the November 14, 2016 special meeting minutes from November 23 and the following bills, a motion was made by Dodd, seconded by Wyborny to approve the consent agenda. Motion carried unanimously.

November 14, 2016

Mayor Dodd then called for New Business; Motion by Dodd, Second by Prazak to approve the Annual report to the State of Iowa as prepared. .All ayes.

Mayor Dodd then called for Old Business; Mayor Dodd mentioned a newspaper clipping that he and members of the council had received in the mail. The minutes of the Rudd council meeting
were enclosed that highlighted a motion about s resident moving his LP tank. The document was unsigned with no return address and will not be addressed by the council.

City Clerk then informed the council that there had been a few more responses to the motto contest and so it will run again in the next newsletter. At the January meeting the council will
choose their top three to be presented to the residents to vote on.

Tabled was the freedom rock and welcome signs until more information can be gathered.

Council Dodd reported that Tim Navratil will be replacing the sidewalk at Mill Street in the spring.

Mayor Dodd then called for Other Reports; Council Dodd then informed the council he had inspected the property at 104 N. Nottingham Street now owned by the city. Josh Kittleson has
agreed to bring the well casing up to 2’ above of the ground. Motion by Brosz, Second by Council Ennis to approve hiring Josh Kittleson to weld the extension on the well casing. All
Ayes, Motion carried.

Council Prazak informed the council that there are a few grants that the city could apply for that would help pay for the welcome signs, the city would have to match he funds.
Landfill report: Council Brosz then gave a brief update on the landfill meeting.

October 10, 2016
The Regular Meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Randy Dodd. In attendance were, Council Jodi Wyborny, Council Mark Brosz, Council Tim Dodd, and Council Jessica Prazak. Absent was Council Scott Ennis and City Clerk, Tracy Ward.

Mayor Dodd then called for Old Business; Council Dodd then talked about the porta potty project in city park.
Due to the weather changing the project was tabled until spring.

Council Wyborny then informed the council that there had been one more response to the motto contest and are hoping for a few more, so it will run again in the next newsletter. Tabled was the freedom rock and welcome signs until more information can be gathered.

Mayor Dodd then called for Other Reports; Council Dodd then informed the council he had inspected the property at 104 N. Nottingham Street now owned by the city. The metal lid just north of the well is actually an old cistern, approximately 7’X8’ and 6’ deep. After a brief discussion the city will contact Navratil Excavating to fill in the old cistern and to dig out the well pit so the well casing can be brought up to 2’ above of the ground, as rain and mud have filled up the hole.

Council Prazak informed the council that there are a few grants that the city could apply for and would present more information at next meeting.

Phone vote was initiated to get approval to do the paving of the alley section on the west side of Glover next to 102 N Glover to correct the drainage issue. Motion carried.

Phone vote was initiated to get approval to hire Keeling tree service to trim the trees on the city streets. Vote was needed to get on the schedule. Motion carried.

September 12, 2016

The Regular meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Randy Dodd. In attendance were, Council Jodi Wybomy, Council Tim Dodd, Council Mark Brosz. Also in attendance were Dan Thorsen and Adam Stone.
Absent were Council Jessica Prazak and Scott Ennis.

Mayor Dodd then called for New Business; Dan Thorsen's building permit was presented for changes to new garage on the property. Since there were no changes to setbacks, no new approval was needed.

Adam Stone's building permit was presented for a wraparound porch to be added to his residence. After review, a motion was made by Dodd, seconded by Wybomy approving the building permit. Motion carried unanimously.

Motion by Dodd, Second by Brosz to approve the Road Use Tax report to be submitted to the Iowa Department of Transportation. Motion carried unanimously.

Resident Doug Heimer wants the sidewalk at 1 West Mill Street running north south to be replaced. Council Dodd will talk to Hella Meyers and offer labor, if they buy the materials.

The Well casing at 104 N Nottingham Street was discussed as it needs to be brought up to grade. Council Dodd will make contact to see what can be done and the cost. Once the well casing is brought up then the hole can be filled in. Council Dodd commented that 15 feet north of the well is another piece of metal that may need to be addressed.

Council Dodd presented more information on the project, he has asked talked to a local operator for bids for the porta potty structure. Rye recommends bi-monthly maintenance on the unit as they can start to smell. He would give the city a option to buy used from him.

Tabled was the city welcome signs. The motto contest produced two responses. Council wishes to run it again in the next newsletter to see if get any more responses.

August 8, 2016

The Regular Meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Pro Tern Mark Brosz. In attendance were, Council Jodi Wyborny, Council Tim Dodd, Council Jessica Prazak and Council Scott Ennis. Also in attendance were Dan and Deb Thorsen. Absent was Mayor Randy Dodd.

Mayor Pro Tern Mark Brosz then called for New Business; Dan Thorsen's building pe1mit was presented for an new garage on the property. After review, a motion was made by Wyborny, seconded by Prazak, approving the building permit. Motion carried unanimously.

Bill Heiny's building permit was presented for an driveway on their property. After review, a motion was made by Dodd, seconded by Ennis approving the building permit, with the recommendation that they get written approval from the county since they are creating a new approach. Motion carried unanimously.

Motion by Wyborny, Second by Prazak to approve the cigarette license for the Rock Falls Lounge. Motion carried unanimously.

Discussion of building a structure in the park to house a porta potty was presented. The issue was tabled until more information could be obtained. The structure would have to allow for handicap accessibility. Council Dodd presented more information on the project, he has asked for bids for the porta potty structure. They run around $3300 dollars. Rye recommends monthly maintenance on the unit as they can start to smell. He would give the city a monthly rate 'of $35.

Tabled was the city welcome signs. The motto contest will be added to the next newsletter with a winner receiving $50.
Council Brosz gave the Landfill report. They will have five larger drop off bins. The electronics building has been remodeled for storage and the restore. They met with the DNR to review the new customer convenience center that they received grant money to build.

Tree trimming was discussed. Clerk has contacted Kevin Keeling and asked that he meet with Mark or Tim to go over the areas needing trimmed. Clerk called Rock Creek and their quote is $3200.

Mayor Dodd then called for New Business;
Liquor License for Rock Falls Fun Days 2016. After review, a motion was made by Dodd, seconded by Brosz, approving the license. Motion carried unanimously .

Gambling License for Rock Falls Fun Days 2016 . After review, a motion was made by Wyborny, seconded by Dodd, approving the license. Motion carried unanimously .

Motion by Wyborny, Second by Brosz to approve the purchase of the new flow meter to replace the one that was struck by lightning. Motion carried unanimously. Clerk will call and submit a claim to Haines Insurance and have them call Kit from Quality Pump to confirm.

Mayor Dodd has requested that the city fix the drainage problem on North Glover. There is a washout problem that happens after every rain. Having the area paved could be the answer. Council Wyborny and Council Brosz will call to get some quotes on the project.

Mayor Dodd suggested that the city have a contest to create a town motto or to get a Freedom Rock and have it painted. Possibly to have welcome signs posted outside the city limits. Council Brosz suggested that there might be grant money available for this kind of project.

Council Dodd presented his findings for the portapotty in the park. The existing cement structure could be redesigned to house the portapotty. The structure would have to allow for handicap accessibility, which would require a new pad to be poured on the north side. The question about access for maintenance was also discussed. The company has a 40' hose.

Betterment report: Mayor Dodd attended the meeting. They discussed Rock Falls Fun Days and the increase from Waste Management.

The clerk reported that the Adams foundation grant money had been received and would be deposited to the Covered Bridge account at Clear Lake Bank.

Clerk is going to purchase a new monitor to replace the old one.

The Regular Meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Randy Dodd. Council Jessica Prazak was a late arrival.

Betterment report: There is no report for the meeting.

Keely and Cathy Pope presented a bill for repairs to their grinder system that was completed by Kevin Pope. The joint was never properly connected. Motion by Brosz, Second by Wyborny to approve the payment.

The mayor reported that the grant paperwork to the Adams foundation had been completed and submitted.

Clerk is to purchase a mayors seal stamp to replace the old one. The impression stamp is not viewable when documents need to be faxed.

Council Brosz gave the Landfill report. Hazardous Collection will be June 20th from 3:30 – 5 pm in Nora Springs. They will have five larger drop off bins. The electronics building will be remodeled for storage and the restore. They will meet with the DNR to review the new customer convenience center that they received grant money to build. The new caterpillar/compactor has been delivered.

The empty lot at 104 N Nottingham will have safety fence put around the well pump area. Sharm Ward will purchase grass seed and spread it on the east side.

Tree Trimming was discussed. It has been a long time since they have been in town to trim trees in the city’s right of way. Clerk is to call Rock Creek and see when they are available.

Betterment report: Tim Dodd attended the meeting. They are discussing Rock Falls Fun Days 2016 and researching garbage services. They are looking to resurface the tennis courts.

April 11, 2016

The Regular Meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Randy Dodd. In attendance were, Council Jessica Prazak, Council Jodi Wyborny, Council Mark Brosz, Council Tim Dodd, and Council Scott Ennis. Also in attendance were Abby and Kevin Pope, Lori, Lance and Lincoln Jost, Cliff and Linda Weatherwax, Kathy Pope and Keely Fingalsen, Rick Wyborny and City Attorney John Duffy.

Mayor Dodd then asked for a motion to approve the consent agenda. After reviewing the agenda, minutes of the March 14, 2016, meeting and the following bills, a motion was made by Brosz, seconded by Prazak to approve the consent agenda. Motion carried unanimously.

The council then reviewed the People Service report. Wyborny also informed the council that Wade Flatten had removed the electrical box from 104 N. Nottingham prior to the work being done for demolition. Flatten also stated that he had been called by the county for locates on the roads running through Rock Falls, he didn’t know at this time what road work was to be done.

Mayor Dodd then called for New Business; Mayor Dodd then submitted his building permit for a new deck on his house. After review, a motion was made by Brosz, seconded by Prazak, approving the building permit. Motion carried unanimously.

In the absence of Tracy Ward, Wyborny explained the request for a scanner that can scan multiple paper and sizes, and then organizes them in a software program. The price would be approximately $250 or less. After a brief discussion, a motion was made by Prazak, seconded by Dodd approving the purchase of a new scanner. Motion carried unanimously.

Mayor Dodd then asked the council to set the public hearing for the “Notice of Public Hearing on Proposed Vacation”. Following discussion the date was set for Monday, April 18, 2016 at 7:00 p.m.

Mayor Dodd then called for Old Business; Wyborny then updated the council on the progress being done at 104 N. Nottingham, now owned by the city. Bergo Environmental had completed the asbestos removal on the house and People Service had removed all the necessary equipment. Navratil Excavating will be notified next that the house and garage is now ready for demolition, and will be completed by June 1, 2016.

Mayor Dodd then asked John Duffy, City Attorney, to update the council on the “Vacation of Various Streets and Alleys” and Conveyances to the property owners involved. Duffy informed the council that after careful reviewing of all documents, changes were made involving additional conveyances and parties involved. Duffy explained the process to vacate and convey the legal descriptions and again went over the contracts. Duffy had all the necessary paperwork and contracts that were then signed by all parties involved. Tracy Ward had then arrived and also sign the necessary contracts.

In other discussion, it was decided to hold the cities “Big Trash Day” on April 30, 2016.

March 14, 2016
The Regular Meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Randy Dodd. In attendance were, Council Jessica Prazak, Council Jodi Wyborny, Council Mark Brosz, Council Tim Dodd, Council Scott Ennis and City Clerk, Tracy Ward. Also in attendance
were Abby Kelley, Kevin Pope, Dave Deinhart-Absolute Waste, Sandy Landy-Waste Management, Rick Wyborny, Lori and Lance Jost and Wade Flattum-PeopleService.

Mayor Dodd then asked for a motion to approve the minutes of the February 8, 2016, meeting. Motion by Wyborny, seconded by Prazak to approve the minutes. All Ayes, Motion carried.

Wade Flatten from People Service went over the report for February. Council discussed the February 2016 wastewater operation & maintenance report. The E1 were delivered. Helps Drain will be doing some work at the lagoon cleaning the manhole. It was decided that the Peopleservice operator would be present at meetings on a quarterly basis. He will attend the July meeting and update all months unless some major needs to be addressed.

Mayor Dodd then called for Old Business; City Clerk Tracy Ward had contacted City Attorney John Duffy on February 29th for an update. He stated he was drafting the document. No further updates were available as Mr. Duffy was on vacation. Council Wyborny will contact him on March 21 for an update and email the results to
Abbey and the Josts.

Mayor Dodd then called for New Business
Mayor Dodd opened the public hearing for the FY 2017 Budget. There being no public comment, Mayor Dodd closed the public hearing. Motion to approve Resolution 03142016C Budget for FY 2017 made by Prazak, seconded by Brosz to approve the budget and submit to the state. All Ayes. Motion carried.

Mayor Dodd opened the public hearing for the Code of Ordinance update. There being no public comment, Mayor Dodd closed the public hearing. Motion by Brosz, second by Dodd to approve the code update. All Ayes. Motion carried.

Discussion on whether the city has any ordinance in effect that would protect the city from allowing strip clubs to open in the City of Rock Falls. The city is under restricted residential; we have no zoning commission that can regulate the zoning for the commercial property. A zoning board would need to be 6-7 members consisting of members that are not currently serving a public office for the city.

The sealed bids for the garbage service were opened and distributed to the council. After much deliberation, Motion by Dodd, Second by Prazak to approve the 3 year contract with Waste Management based on price and the advantage of the recycle toters. Clerk thanked Dave Deinhart from Absolute Waste and encouraged him to
bid again in three years when the bid packets will be sent out again.

The council has set Saturday April 30th as the Big Trash pickup event. More details will be mailed in the April Utility billings.

Lee Haines, the City’s Insurance agent was on hand to go over the new policy.

Motion by Brosz, Second by Prazak to accept the bid from Bergo Asbestos removal concerning 104 N Nottingham. The window glazing and the siding will be removed and disposed of following all guidelines.

Betterment report: Council Prazak then reported on the Betterment meeting she attended. There was limited attendance at the annual meeting.
Landfill report: Council Brosz stated the meeting had been postponed.

February 8, 2016
The Regular Meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Randy Dodd. In attendance were, Council Jessica Prazak, Council Jodi Wyborny, Council Mark Brosz, Council Tim Dodd, and Council Scott Ennis. Also in attendance were Abby Kelley and Kevin Pope. Absent was City Clerk, Tracy Ward.
Mayor Dodd then asked for a motion to approve the minutes of the January 11, 2016, meeting. Motion by Brosz, seconded by Prazak to approve the minutes, with the addition of adding Roger Luther in attendance. All Ayes, Motion carried.
Wade Flatten from People Service was unable to be at the meeting due to bad weather. Council discussed the January 2016 wastewater operation & maintenance report.

Mayor Dodd then called for New Business; Council Wyborny then asked the council to set the public hearing for the city’s budget to the state for the March 14th, 2016 meeting. A motion was made by Brosz, seconded by Ennis. All Ayes. Motion carried.

The council then went over the bid proposal for garbage service and made notes for Tracy Ward, City Clerk to finish and send out for bid.

Mayor Dodd then called for Old Business; Council Wyborny then presented the demolition bids received on the property at 104 N. Nottingham, now owned by the city. The city will contact Mr. Bergo for an inspection before the demolition of the property. After a brief discussion, Motion by Brosz, seconded by Dodd to approve the demolition bid to Navratil Excavating with the addition of a completion date of June 1, 2016. All Ayes. Motion carried.

Council Wyborny then updated the council along with Abby Kelley and Kevin Pope on the vacation of road and alley’s proposed to be vacated and conveyance. The city’s attorney, Mr. Duffy had been contacted and is proceeding with the documentation’s needed and will keep the city updated. Abby Kelley also gave the city a copy of a letter from Lance and Lori Jost agreeing with the closures. The city will forward the letter onto the city’s attorney.

Council Wyborny then updated the council on the status of the annual code update with NIACOG. A copy of a letter from Chris Diggins, Planner, with NIACOG and draft copies were given to the council for review. The public notice will be added to the March 14, 2016 meeting.

Betterment report: Mayor Dodd then reported on the Betterment meeting he attended.

Landfill report: Council Brosz then gave a brief update on the landfill meeting.

The Regular Meeting of the Rock Falls City Council met at 7:00 p.m. at the Rock Falls City Hall. The meeting was called to order by Mayor Randy Dodd. In attendance were, Council Mark Brosz, Jodi Wyborny, Tim Dodd, Jessica Prazak and Tracy Ward, City Clerk. Also in attendance were Scott Ennis, Rick Wyborny, Abby Kelley, Kevin Pope, Roger Luther, Dave Deinhart from Absolute Waste Removal and Wade Flatten from PeopleService.

Oath of Office was administered to Tim Dodd.

Mayor Dodd then asked for a motion to approve the minutes of the December 14, 2015, meeting. Motion by Prazak, Seconded by Wyborny to approve the minutes, with the addition of the total amount of bills to date for 104 N Nottingham Street: All Ayes, Motion carried.

Appoint to vacancy. Council Brosz mentioned that he had received a letter from resident Don White concerning the vacancy. All council and mayor received the same letter. Motion by Prazak, Second by Dodd to appoint Scott Ennis to fill the vacancy left when Danielle Pace moved from town. The position will be on the 2017 Election. Oath of Office was administered to Scott Ennis.

Wade Flatten from PeopleService gave the December report. Wade went over the monthly report from December. An E1 replacement pump was installed at 211 S Spring St. A proactive replacement is being installed at 6 W Madison St. Motion by Brosz, Second by Wyborny to approve the mayor signing the annual CPI letter. Motion carried.

New Business
Abby Kelley was present to inquire about closing West Jackson that runs through her property. She and Kevin Pope are building a new house. Council stated that she would need to have the property surveyed and get written permission from abiding residents to have the street closed. Then the council can set a public hearing on the matter.

Resolution #1112016B. Motion by Brosz, Seconded by Prazak to approve the purchase of 30,000 CD from Clear Lake, and to move CD 273268 to RUT fund. All Ayes, Motion carried.

Resolution #12142015C. Motion by Wyborny, Seconded by Prazak to approve the application for the City of Rock Falls Debit card. Clerk is able to purchase office supplies and stamps up to $300 without prior council approval. All Ayes, Motion carried.

Old Business: None

Clerks Report. Appointments to boards. Clerk suggested that the council split up the betterment meetings over the course of the year. Also that no payment for attending the meetings, as the betterment board is nonprofit and their members are not paid for meetings.

Scott Ennis was appointed to the Finance committee. Tim Dodd was appointed to the Parks and Utilities committee.

Betterment report. No report.

Landfill report. Meeting is scheduled for Thursday January 14.

Mayors report. Mike Webb of the Cerro Gordo County Conservation has requested a letter of support from the City of Rock Falls to send with the grants they are pursuing for bridge replacement.

The next council meeting will be February 8, 2016, starting at 7:00 p.m.
